I just got a DUI now what?
What is ARD?
ARD is a 1st offenders program that you never plead guilty and are never found guilty. It's not a conviction and you can get the DUI expunged off your record when you complete the program.
* License Suspension? Maybe. It's usually 0-2 months
* Jail time? NO
* Probation? Yes, usually 6 months but it can be up to 2 years. Most of this is non-reporting.
*Cost? $1,400.00 and up
*What else do I have to do? Everyone must take a class and most people have to do counseling as well.
* How do I know if I qualify? Call me and you and I will figure it out!
What happens if I don't qualify for ARD?
You have a choice of fighting the case or pleading guilty. I always want to prepair for a fight. The earlier you contact me, the earlier I get involved and can try to create issues to get your case thrown out.
There are several programs that you may qualify for to reduce your potential sentence if you plead guilty. You make the choice as to fight it or have me negotiate a deal.
What kind of jail time am I looking at?
If convicted these are the mandatory minimums

1st Offense 0-6 months 48 hours-6 months 72 hours- 6 months
2nd Offense 5 days - 6 months 30 days-6 months 90 days- 5 years
3rd Offense 10 days - 2 years 90 days - 5 years 1-5 years
4th Offense 10 days - 2 years 1-5 years 1-5 years
5th or more You better call.
Do they have to read me my rights?
Not necessarily. We would have to talk about it.
Am I going to get a license suspension?
It depends. A 1st offense lowest tier does not carry a license suspension. All other DUI convictions carry some sort of DUI suspension. The length of the suspension is determined by what number offense it is and your BAC. Some 1st offenders may be eligible for an Occupational Limited License after serving 2 months of their suspension.
